CREATOR COPYRIGHT & INTELLECTUAL PROPERTY POLICY

This Creator Copyright & Intellectual Property Policy (the “Policy”) governs the ownership, licensing, and use of content uploaded or published by creators on the Ponchii platform and forms an integral part of the Terms of Use.

This Policy applies to all users who upload, publish, or monetize content through ponchii.com and its related services (the “Platform”), operated by Ponchii OÜ (the “Company,” “we,” “us,” or “our”).

By uploading or publishing content on the Platform, you agree to this Policy.

1. Definitions

Creator – a user who uploads, publishes, or monetizes content on the Platform
User Content – any content uploaded or published by a Creator, including stories, text, images, manga, comics, videos, audio, characters, universes, and related materials
Subscribers – users who purchase subscriptions to access User Content

2. Creator Ownership

Creators retain full ownership of all intellectual property rights in and to their User Content.

Nothing in this Policy transfers ownership to the Company or Subscribers.

Creators may exploit or monetize their content outside the Platform.

3. License Granted to Ponchii

By uploading User Content, the Creator grants the Company a non-exclusive, worldwide, royalty-bearing, sublicensable license to:

host, store, and reproduce content
display, stream, and distribute content
make content available to Subscribers
promote the content and Platform

Duration

This license remains in effect while the content is hosted.

It may continue where necessary to:

fulfill active subscriptions
comply with legal obligations

4. License Granted to Subscribers

Subscribers receive a limited, personal, non-commercial license to access content.

They may not:

copy or reproduce
redistribute or resell
create derivative works
use content commercially

All rights not granted are reserved by the Creator.

5. Creator Responsibilities

Creators confirm that:

they own or have rights to the content
content does not infringe third-party rights
content complies with laws
content is not unlawful or harmful

Creators are solely responsible for their content.

6. Content Moderation

The Company may:

review content
remove violating content
suspend or terminate accounts

Where possible, Creators will be notified.

7. Copyright Infringement Reporting

To report infringement, include:

identification of the work
identification of the content
contact details
good-faith statement
accuracy statement
signature

8. Account Termination

If content is removed or account closed:

access may continue during active subscriptions
data may be retained for legal purposes

The Company is not responsible for lost income due to violations.

9. Relationship

Creators are independent users, not employees or partners of the Company.

10. Changes

We may update this Policy at any time.

Continued use constitutes acceptance.
